ENERGY EARTH UK PERKS POINTS PROGRAM TERMS

These terms and conditions, together with our UK Terms of Website Use, UK Terms and Conditions of Supply, UK Privacy Policy, and UK Cookies Policy (“Terms”) govern the collection and use of Perks Points (“Points”) and set out the terms of your participation in the UK Perks Points Program (“Program”) operated by Energy Earth Limited (“EnergyEarth”, “we”, “us”). Please read them carefully and retain them for your records. By participating in the Program, you (“you” or “User”) agree to abide by these Terms.  We reserve the right to revise and update these Terms at any time without notice.

Perks Points Program. To participate in the Program, Users must qualify for the Program and be issued an account (“Account”) by the applicable loyalty, award or promotional program (such as customer acquisition and retention, rewarding employees, and/or customer loyalty). Users must then activate their Account through the Program’s website (“Point Site”) in order to redeem Points. You will be responsible for maintaining the confidentiality of all logon information, including the Account username and password. You will be responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorised use of your Account details or any other breach of security, and to log out of your Account at the end of each session.

Points are issued in connection with a loyalty, award or promotion program and recorded in the User’s Account. Points are not sold to individual consumers. You acknowledge that any Points collected by you were given to you as a reward and that no consideration, value or money has been paid by you in exchange for the Points.

Reward Options. Users may exchange Points for those reward options (“Rewards”) listed on the applicable Point Site. Rewards may include energy saving products, stored value cards, or other options which may be arranged through third party merchants from time to time.

PLEASE NOTE ENERGYEARTH IS NOT ABLE TO ACCEPT RESPONSIBILITY FOR ANY REWARDS YOU RECEIVE FROM A THIRD PARTY MERCHANT, INCLUDING WITHOUT LIMITATION, ANY DEFECTIVE GOODS OR SERVICES, THE FAILURE OF THE MERCHANT TO HONOR THE REWARD OR THE BANKRUPTCY OR OTHER INSOLVENCY OF THAT MERCHANT. IN SUCH INSTANCE, PLEASE REFER TO THAT MERCHANT’S TERMS AND CONDITIONS FOR FURTHER INFORMATION ON HOW TO MAKE A CLAIM DIRECTLY AGAINST THAT MERCHANT.

If Points are redeemed for a stored value card, there may be an additional charge assessed, which will be notified to you prior to completing the redemption process. Rewards supplied by us will be subject to our UK Terms and Conditions of Supply and Rewards supplied by third parties may be subject to additional specified terms and conditions (including in relation to cancellation restrictions, return conditions, warranties and limitations of liability) which will be notified to you. You should ensure you familiarise yourself with all terms and conditions that apply to any Reward you have selected. All Rewards are subject to change and are only available while supplies last. If a Reward is discontinued after you have redeemed Points for the applicable Reward, reasonable efforts will be made to offer a substitute of equivalent or better quality. If no substitute or equivalent Reward can be provided, the Points redeemed will be reinstated to your account.

Users may apply Points toward a Reward, or combination of multiple Rewards, of greater value than the total value of their Points by using a separate form of payment, up to £300.00, (e.g., debit card, credit card) to complete the checkout process.  

Reward Processing.  Points redemptions will be processed within ten (10) business days.

Points Conditions.  Points expire on the expiration date listed at the User’s account on the Point Site, and any remaining value associated with Points are forfeited on the expiration date. Your oldest Points will automatically be used first when redeemed.  If you no longer participate in or are no longer eligible to participate in the loyalty, award or promotional program that issued your Points, your Points will be immediately forfeited.

Points are personal to an Account and cannot be transferred. Points are not legal tender, have no cash value and are not redeemable for cash. Points can only be earned, held or redeemed in accordance with these Terms. Any other use, award, sale, exchange or transfer of points, or attempt to do so, will be a breach of these Terms. Any Points not earned and held in accordance with these Terms will be invalid and cannot be redeemed for Rewards. Any such Points in an Account will be deducted and, if they are redeemed, we reserve the right to cancel the applicable Reward and may take other appropriate action. Points from more than one Account cannot be combined.

We may close any Account on which no Points have been earned or redeemed for a continuous period of at least 12 months. We may also immediately suspend or close an Account if we reasonably consider that a User has breached these Terms, or has dealt with Points in a manner not permitted by these Terms, or if there has been any theft or misconduct in connection with the Program or if a User has supplied false or misleading information to us. If an Account is closed, all Points contained in the Account at the time of closure will be forfeited.

Governing Law. Please note that these Terms, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
